Ungkapan tersebut layaknya terjadi di desa Bulusari Kecamatan Tarokan Kabupaten Kediri. Pasalnya, warga setempat merasa terombang ambing oleh kasus atas rumah, tanah dan lahan mereka yang sampai sekarang belum ada kepastian terkait harganya dalam proses pembebasan lahan bandara Dhoho Kediri.
Merasa tidak ada kepastian dan terombang ambing atas hak miliknya mereka menggugat Perusahaan rokok raksasa di Kediri yakni PT. Gudang Garam, TBK kantor unit 1 yang beralamat di jalan raya Semampir Kota Kediri kepengadilan Negeri Ngasem Kabupaten Kediri.
Menurut laman resmi sipp.pn-kedirikab.go.id/index no perkara : 182/Pdt.G/2021/PN.Gpr. Keberatan atas ganti rugi pengadaan tanah bagi pembangunan untuk kepentingan umum. Dan dibenarkan oleh humas PN Ngasem Kediri, M.Fahmi Hary Nugroho, S.H, M.H.
Dalam sidang gugatan pertama di PN Kabupaten Kediri tersebut, Kamis ( 9/12/2021) pagi, majelis hakim yang mulia di pimpin oleh
M.Fahmi Hary Nugroho, S.H, M.H. Sedangkan Penggugatnya adalah Purwito. Adapun tergugat yakni :
1. BPN/ATR Kantor Pertanahan Kabupaten Kediri Propinsi Jawa Timur.
2. PT. Perusahaan Rokok Tjap Gudang Garam Tbk Kantor Unit I
Mengabulkan permohonan keberatan pemohon. Menetapkan besarnya harga tanah per meter persegi serta uang ganti kerugian untuk tanah pemukiman saya seluas 510 M2 dikalikan Rp. 4.000.000 /M2 sama dengan Rp.2.040.000.000,-. Serta penambahan Uang Ganti Rugi Usaha sebesar Rp. 300.000.000 untuk kompensasi kedua usaha kami.
Dan penilaian untuk selain tanah, baik fisik yang meliputi bangunan, tanaman, sarana dan benda lain dinilai tetap seperti yang tertera dalam penilaian appraisal. Sedangkan penilaian non fisik yang meliputi biaya pindahan, BPHTB, biaya notaris, masa tunggu, serta selisih reproduksi/replacement cost dihitung lagi (disesuaikan) dengan nilai baru yang kami mohonkan.
- Menghukum Termohon Keberatan untuk melaksanakan pemberian Uang Ganti Kerugian sesuai Permohonan saya.
- Menghukum Termohon Keberatan untuk membayar biaya perkara.
Hari ini sidang pertama pembacaan keberatan, pembacaan jawaban, kemudian bukti surat dari pemohon. Agenda sidang selanjutnya Selasa minggu depan. pembuktian surat dari pihak termohon dari GG dan BPN dan saksi dari pemohon.
Dijelaskan bahwa, dalam sidang pertama ini pihak tergugat yakni PT. GG diwakili kuasa hukumnya Rini, S.H. beserta tim dan juga dari BPN/ATR Kabupaten Kediri.
Usai sidang, Rini, S.H kuasa hukum dari tergugat (PT.GG) saat dimintai konfirmasi mengatakan, hari ini merupakan sidang permohonan dari pihak pemohon kemudian dari kita jawaban pak. Pemohonnya dalam hal ini warga …tapi saya nggak hafal warga desa apa ya…!!! ?? “Bulusari”….!!!??? ..waduh saya tidak hafal pak pokoknya diantara itu. Ada tiga tadi ya.. tapi saya kurang paham …!! tidak hafallah mungkin dari warga disitu pak, “ucapnya.
Isinya dari pemohon disitu adalah minta gant rugi terkait masalah lahan warga yang terkena dampak bandara itu. Saat ditanya berapa mintanya ganti rugi para pemohon per meternya, Rini, S.H mengatakan, saya kurang faham Lo pak…” Nanti saya tidak membuka dengan pasti ini, “terangnya.
Lanjut Rini. S.H kuasa dari termohon PT. Gudang Garam, TBK, Kediri menjelaskan, pada sidang pertama hari ini dari sana ya masih permohonan ya itu dibaca dan kita menyampaikan jawaban, tadi sudah kita sampaikan ke Majelis hakim dengan tertulis.
“Poin jawaban kami yakni menanggapi yang sudah disampaikan pemohon, itu sudah masih kemateri nanti biar dari humas PN sajalah yang menjawab. Hari ini merupakan sidang pertama, kan permohonan sudah masuk secara ekot….eh nggak tahulah saya..kemudian kita waktunya menyampaikan jawaban, ya ini sekarang tadi, “ujarnya.
Rini menambahkan, saat ditanya intinya disidang perdana ini apa benar warga terdampak desa Bulusari minta ganti rugi atau ganti untung…??? Rini menjelaskan mungkin ya seperti itu ..sambil senyum dan ketawa kecil…Apakah pihak GG akan menyetujui apa tidak dia menjawab, ya itu sudah masuk kepada materi biar nanti saja dari pihak Pangadilan saja ya…kan itu sudah masuk kepada materi persidangan.
“Jadi hari ini masih sidang pertama waktunya permohonan dari pemohon dan jawaban dari termohon. Untuk sidang selanjutnya akan digelar besuk hari Selasa (14/12/2021) yakni sidang pembuktian dari para pemohon,” bebernya.
Ditempat berbeda Suryadi yang biasa di sapa Gus Yadi saat dimintai tanggapannya terkait kasus di bandara Dhoho Kediri menjelaskan, tanah yang dibuat lahan bandara Dhoho Kediri itu tanah milik siapa…???!!!
“Saya sebagai wakil pemilik tanah egendom pervonding nomer 4434 . 4435 4436 4437 dengan luasan 582 ha yang terletak di lokasi bandara Dhoho Kediri masih terus mengejar dan mengurus tanah tersebut termasuk dengan foto satelit dan rekomendasi dari geospasial Bandung. Hal tersebut kami lakukan sesuai dari petunjuk dan arahan serta permintaan salah satu pejabat dari BPN/ATR Kabupaten Kediri,” ucapnya, Jum’at (19/12)2021) pagi.
Lanjut pria yang juga mantan Bendahara Induk Koperasi Syirkah Muawanah (Inkopsin ) PBNU tersebut menambahkan, Saya masih minta foto satelit kepada geospasial Bandung. Saya sebagai bagian dari waris dan mewakili seluruh ahli waris ‘Njimas entjeh siti aminah” yang dikuasakan kepada saya menyatakan, Kami tidak ada sangkut pautnya dengan gugatan mereka, para warga di tiga kecamatan tersebut karena semua itu kemungkinan ada dalam area lahan egendom pervonding yang kami miliki.
